These Terms of Service (the "Terms") form a legally binding agreement between you and R.A.Y.K.A, a business entity registered in the United Arab Emirates, operating the website and service known as MyColorSeason ("we", "our", "us") at mycolorseason.co (the "Service"). By purchasing or using the Service, you agree to be bound by these Terms.

1. The Service

MyColorSeason is an online personal color analysis service. You upload a photo of yourself; our software analyzes your skin tone, eye color, and hair color using automated techniques including artificial intelligence; and we deliver a digital color report indicating your personal color season, a recommended color palette, colors to avoid, and styling suggestions.

The report is a digital product for personal styling guidance. It is not medical, dermatological, psychological, or professional advice. Do not rely on it as a substitute for professional counsel.

2. Eligibility

You must be at least 18 years old to use the Service. By purchasing, you represent and warrant that you are 18 or older and have the legal capacity to enter into this contract.

3. Pricing and payment

• The Service is offered as a one-time purchase of USD $9.99 (or local-currency equivalent). There is no subscription and no recurring charge.
• Payment is processed by Stripe, Inc. By purchasing, you agree to Stripe's terms and authorize the charge.
• Prices are shown in US dollars unless otherwise indicated. Any applicable taxes are your responsibility unless the price explicitly states "tax inclusive."
• We may change pricing at any time, but changes will not affect orders already placed.

4. Your content and license

You retain ownership of the photo you upload ("Your Content").

By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, process, and analyze Your Content solely for the purpose of:

• Generating and delivering your color report;
• Improving the accuracy and quality of our color-analysis technology, using anonymized or aggregated data only;
• Complying with legal obligations.

We will not publish, sell, or license Your Content to any third party. We will not use your face or likeness in advertising without your separate, explicit consent.

You represent and warrant that:

• You are the person shown in the photo, or you have the express permission of the person shown to upload it.
• The photo does not infringe any third party's rights.
• The photo does not contain unlawful, defamatory, or sexually explicit content.

5. Our intellectual property

All content we provide — the website, the report template, the recommendations, the palette system, the text, graphics, and software — is owned by R.A.Y.K.A or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a personal, non-transferable, non-exclusive license to use your delivered report for personal, non-commercial purposes. You may not resell, redistribute, or reverse-engineer the report or the Service.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload photos of other people without their consent.
• Submit deceptive or manipulated images intended to defraud or misuse the Service.
• Attempt to access, scrape, or reverse-engineer the Service, APIs, or infrastructure.
• Use the Service in a way that could damage, disable, or impair it.
• Resell access to the Service or share your report in bulk.

We may suspend or terminate access to the Service for any breach of these Terms.

7. Refunds

We offer a 14-day money-back guarantee on every order, subject to our Refund Policy. Please read the Refund Policy for details on how to request a refund and any limited exclusions.

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

Color analysis is a subjective aesthetic guidance tool. We do not warrant that the report will make you look better, help you find clothes, or produce any specific outcome. Results depend on factors including photo quality, lighting, styling choices, and personal preference.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event will R.A.Y.K.A or its directors, employees, agents, or suppliers be liable to you for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising from or related to your use of the Service.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service will not exceed the amount you actually paid us in the 12 months preceding the claim, or USD $9.99, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable UAE law, including liability for death or personal injury caused by gross negligence, fraud, or willful misconduct.

10. Indemnification

You agree to indemnify and hold harmless R.A.Y.K.A and its personnel from any claim, damage, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) Your Content; (c) your violation of any law or third-party right.

11. Governing law and dispute resolution

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be submitted to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

Before filing a claim, you agree to contact us at support@mycolorseason.co and attempt in good faith to resolve the dispute informally for at least 30 days.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, give reasonable notice. Your continued use of the Service after a change constitutes acceptance of the new Terms.

13. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the rest of the Terms will remain in effect.
• No waiver. Failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
